They also cover the terms and conditions for the relationship between prospective customers and Childcare Providers brought together via Gatistavam Limited and the relationship between Gatistavam Limited and anyone using the site for whatever reason.

By accessing or using this Site or otherwise indicating your consent you agree to be bound by these terms and conditions as well as our Privacy Policy.

Accuracy and information on the Site

Gatistavam Limited acts as a window for users to interact with Childcare Providers. A user of this Site is able to contact Childcare Providers directly and all contractual relationships that arise as a result of using this Site are between the Childcare Provider and the site user. Gatistavam Limited are not involved with any contractual relationships between Childcare Providers and users of the site and are not liable for any loss incurred due to out of date information.

Whilst every care has been taken to ensure the accuracy of the information contained in this website Gatistavam Limited will not be held responsible for any loss, damage or inconvenience caused as a result of any inaccuracy or error within these pages. Childcare Providers are responsible for all the information on this site and for advising Gatistavam Limited with any changes and discrepancies. Gatistavam Limited will not be held liable for any loss incurred due to out of date information on the site.

Although Gatistavam Limited strive to keep the site updated with correct information given to us by Childcare Providers we cannot be held responsible for any Childcare Provider that does not replicate the information on this site. While we are not responsible for the overall condition of any service and care listed on our site or the compliance with laws or regulations that may be applicable to the Childcare Provider, we only list Childcare Providers with an Ofsted rating of 1-3. Any Childcare Provider rated to a level 4 by Ofsted will have their account with us suspended.

Should you book a slot listed on the Gatistavam Limited website you are strongly advised to the read the relevant nurseries' terms and conditions.

Privacy & policy

When you make an enquiry to book a slot your email address and contact details that you have added to your enquiry are passed on to provider.

All details held at Gatistavam Limited follow our strict Privacy Policy and are never shared to third parties (other than when you make a booking and are shared with that owner).A copy of our Privacy & Policy is available upon request (or by clicking here)

Provider Reviews

You are able to leave reviews for Childcare Providers that you have used. Spam reviews are not allowed and all reviews will be verified before being activated.

Unauthorized use of the site without limitation:

Gatistavam Limited and its content are protected by copyright you may not copy or reproduce any information within the site for any reason what so ever unless authorized by Gatistavam Limited.

Hyperlinks and third party sites

The Gatistavam Limited Site may contain hyperlinks or references to third party websites that are deemed relevant. Any such sites or hyperlinks are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content.

General

1.1 Relationship

The parties are independent businesses and not a joint venture, partners, or employer and employee.

1.2 Assignment

Neither party may assign its rights or obligations under this Agreement without the prior written consent of the other.

1.3 Variation

No amendment or variation of this Agreement will be valid unless confirmed as agreed in writing by an authorised signatory of each party.

1.4 Severability

The unenforceability of any part of this Agreement will not affect the enforceability of any other part.

1.5 Waiver

No delay, act or omission by either party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

1.6 Rights of Third Parties

This Agreement will bind and benefit each party's successors and personal representatives. Subject to that, this Agreement is not enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

1.7 Entire Agreement

This Agreement is the entire agreement between the parties in relation to its subject. No other terms apply.

1.8 Governing Law & Jurisdiction

• 1.8.1 This Agreement will be governed by the law of England and Wales

• 1.8.2 Disputes will be submitted to the exclusive jurisdiction of the courts of England and Wales.

Force Majeure

1.9 Force Majeure means an event or sequence of events beyond a party's reasonable control preventing or delaying it from performing its obligations hereunder. Inability to pay is not Force Majeure.

1.10 A party will not be liable if delayed in or prevented from performing its obligations due to Force Majeure, provided that it:

• 1.10.1 promptly notifies the other of the Force Majeure event and its expected duration, and

• 1.10.2 uses reasonable endeavours to minimise the effects of that event.

1.11 If, due to Force Majeure, a party:

• 1.11.1 is or will be unable to perform a material obligation, or

• 1.11.2 is delayed in or prevented from performing its obligations for a continuous period exceeding one day the parties will, within one business day, renegotiate the Agreement to achieve, as nearly as possible, the original commercial intent
